Why is it illegal??

Cannabis Sativa is the flower of a plant that is dried and smoked, vaporized, or ingested in food through cooking with canna-butter. The major psychoactive chemical compound in cannabis is Δ9-tetrahydrocannabinol (commonly abbreviated as THC). Cannabis contains more than 400 different chemical compounds, including at least 66 other cannabinoids (cannabidiol (CBD), cannabinol (CBN) and tetrahydrocannabivarin (THCV), etc.) which can result in different effects from those of THC alone. When used the active chemical in the plant, THC, works in the brain causing the user to feel "high." This can be described and experienced in many different ways depending how it agrees or disagrees with the user. Most commonly effects are a feeling of a calm easy escape from the everyday stress on the mind, laughing, "munchies", as well as many other feelings.

But that's not all, if we go back in time, it all started as early as 1906 when the Pure Food and Drug Act was passed in the U.S. and the Food and Drug Administration was formed. This was the first time drugs had any government oversight. California passed the first state marijuana law in 1913, but it was largely overlooked because it specifically addressed "preparations of hemp, or loco weed." Other state anti-marijuana law were passed in Utah in 1915, in Texas in 1919, Louisiana in 1924 and New York in 1927. Then in 1928, the recreational use of marijuana was banned in Britain. 

On October 2, 1937, without any open debate, scientific enquiry, or political objection, President Roosevelt of America signed the Marijuana Tax Law. The law made it illegal to possess marijuana in the U.S. without a special tax stamp issued by the U.S. Treasury Department. In theory, growing and selling marijuana was still legal as long as you bought the government tax stamp for $1.00. However, the Treasury Department did not issue any tax stamps for marijuana, effectively making growing, selling and possessing marijuana illegal under the Act. Using the then-considerable influence of the United States, over 100 countries to consolidate their drug agreements into a single convention that would make marijuana illegal around the world in the 60s'. 

Well what about the law in Malaysia? Below are the legality of cannabis of each country and here's the extract of Malaysian law:

"Malaysian legislation provides for a mandatory death penalty for convicted drug traffickers. Individuals arrested in possession of 15 grams (1/2 ounce) of heroin or 200 grams (seven ounces) of marijuana are presumed by law to be trafficking in drugs." - http://en.wikipedia.org/wiki/Legality_of_cannabis_by_country

According to LAWS OF MALAYSIA ACT 234, DANGEROUS DRUGS ACT 1952 

"Any person who keeps or has in his possession, custody or control any raw opium, coca leaves, poppy-straw or cannabis or the seeds of the plants from which they may be obtained either directly or indirectly, except under and in accordance with an authorization such as is referred to in sections 4 and 5 or with any regulation made under section 7 thereof, shall be guilty of an offence against this Act and liable on conviction to a fine not exceeding **twenty thousand ringgit or to imprisonment for a term not exceeding five years or to both." - http://www.agc.gov.my/Akta/Vol.%205/Act%20234.pdf


However, I've heard some guy got life sentence for smoking pot even though it says 'not exceeding 5 years'. I can't find the news anywhere so if you can make sure or correct me then it would be great.




What is Cannabis?

Should we legalise cannabis in Malaysia? What is cannabis some may ask.. Well cannabis, also known as marijuana; weed; pot; grass; or some of us in malaysia always refer it as ganja, is a type of illegal drug worldwide.. I'm pretty sure you do know what cannabis is now right? If you still have no clue about what it's, I recommend you to go google it.. 

  • Please note that I do not smoke or sell weed so don't come and ask me where you can get it in Malaysia.. I strongly suggest you not to buy it in Malaysia as the law for containing weed or smoking a joint will end you up in jail for LIFE or you can say babye to your family and friends.. This blog is only about whether we should legalise cannabis in Malaysia or not..
